Though there is no compiled evidence, it is estimated that up to seventy percent of people die without writing a will. However, passing on without doing so leaves a host of problems for surviving loved ones at what is already an obviously complicated and emotional time.

As a legally binding document, a will ensures that property and assets are dealt with according to a person’s wishes following their death. Dying without a will results in the legal system determining how everything should be distributed and taking their cut wherever applicable.

It can sometimes also result in quite bitter and personal rows and arguments between family members. Upsetting in itself of course, such events are the last thing that it is needed under already difficult and naturally sad times. Further than this, planning how an estate is to be distributed helps minimise tax deductions against it; better for the family again.

Making a will also allows for any gifts to other favoured friends to be noted, and gives the opportunity for provisions to be given to any charities that are close to the heart. Trusts can be created too, and the appropriate appointment of guardians and trustees dealt with, with thought and planning.

For many though, being able to give clear instructions as to how they want their funeral to be conducted is an important part of will writing. From deciding upon readings and hymns, to covering any wishes regards burial or cremation - all can be mentioned to give guidance and direction.

Whether to protect family and friends from not getting what is meant for them, or to make sure a passing is commemorated in just the right way, ensuring a will is in place is more than a good idea. It is possible to write a will without a solicitor present, though seeking professional advice is always advisable.
